Filed By: Save Passamaquoddy Bay
Filed Date: 2/28/2013
Accession No: 20130228-5395
Description: Downeast LNG's purpose and need comment of Save Passamaquoddy Bay under CP07-52, et. al.

Summary: Canaport LNG (a mere 40 miles from proposed Downeast LNG) output is down 42% this winter, compared to last winter, due to the ocean of US domestic natural gas near New England. There is a vast domestic supply, invalidating Downeast LNG's purpose and need.

Mar 5

Filed By: Save Passamaquoddy Bay
Filed Date: 3/5/2013
Accession No: 20130305-5024
Description: Canaport LNG book value, comment of Save Passamaquoddy Bay under CP07-52, et. al.

Summary: Canaport LNG's 75% owner Repsol has reduced the book value of Canaport by $1.3 billion, due to Canaport's poor performance. Canaport LNG has failed to meet its contract obligations and failed to sell to Royal Dutch Shell in Shell's buyout of the rest of Repsol's world LNG assets, due to the vast ocean of domestic natural gas in the US.

Canaport's dramatic decline impeaches Downeast LNG's purpose and need.

Mar 12

Filed By: [Dr. James Venart] Save Passamaquoddy Bay Canada Inc.
Filed Date: 3/12/2013
Accession No: 20130312-5030
Description: Comment J E S Venart PEng, on "Recommended Parameters for Solid Flame Models for Land Based Liquefied Natural Gas Spills," on behalf of of Save Passamaquoddy Bay Canada Inc. under AD13-4, et. al.

Summary: Dr. James Venart documents the numerous failings used by FERC and Downeast LNG in vetting thermal radiation from an LNG fire at the terminal and pier. Dr. Venart demonstrates that Downeast LNG's terminal site is too small to contain the thermal radiation from an LNG fire as required by regulation.

Mar 21

Filed By: Save Passamaquoddy Bay
Filed Date: 3/21/2013
Accession No: 20130321-5053
Description: Innocent Passage comment of Save Passamaquoddy Bay under CP07-52, et. al.

Summary: Save Passamaquoddy Bay demonstrates that the US Department of State claim of right of innocent passage under the UN Convention on the Law of the Sea (UNCLOS) through Canadian waters to the proposed Downeast LNG terminal (and the now-defunct Quoddy Bay LNG and Calais LNG terminals) is fraudulent. Additionally, FERC and the US Coast Guard, instead of blowing the whistle on the Department of State, have been complicit in the fraud.

Save Passamaquoddy Bay suggests that the State Department withdraw its opinion, and demands that FERC dismiss Downeast LNG's applications.

NOTE: This comment has been revised due to three errors. See the March 25 comment, Accession No. 20130325-5031 for the revised version.

Mar 22

Filed By: Save Passamaquoddy Bay
Filed Date: 3/22/2013
Accession No: 20130322-5154
Description: Name correction to 2013 Mar 21 comment re Innocent Passage, Accession No. 20130321-5053, by Save Passamaquoddy Bay under CP07-52, et al.

Summary: Save Passamaquoddy Bay's Mar 21 comment (Accession No. 20130321-5053) erred in the name of the US Coast Guard Chier of International and Maritime Law. The correct name and new rank are: RADM Charles Michel. (We had mistakenly referred to him as "CAPT. Stephen Michel." He was a US Coast Guard Captain when he made the referenced statement, but is now a Rear Admiral.)

RADM Michel admitted that the US has no standing in international court regarding innocent passage since the US is not a party to the UN Convention on the Law of the Sea (UNCLOS); thus, the US Department of State claim of innocent passage rights under UNCLOS are indefensible.

Mar 25

Filed By: Save Passamaquoddy Bay
Filed Date: 3/25/2013
Accession No: 20130325-5031
Description: Revised Innocent Passage comment of Save Passamaquoddy Bay under CP07-52, et al.

Information: FILE LIST

Summary: This is a revision of Save Passamaquoddy Bay's March 21 comment, Accession No. 20130321-5053...

  • Correcting the first name, and providing the new rank, of US Coast Guard RADM Charles Michel (who publicly indicated that the US Department of State's claim of UNCLOS innocent passage to Passamaquoddy Bay LNG import terminals has no legal standing in any international court);

  • Providing the correct date (2005 Jun 1) that the Bureau of Indian Affairs fraudulently approved the ground lease between Pleasant Point Tribal Government and Quoddy Bay LNG; and

  • Correcting the spelling of then-Secretary of State Condoleezza Rice's first name.

Save Passamaquoddy Bay demonstrates that the US Department of State claim of right of innocent passage under the UN Convention on the Law of the Sea (UNCLOS) through Canadian waters to the proposed Downeast LNG terminal (and the now-defunct Quoddy Bay LNG and Calais LNG terminals) is fraudulent. Additionally, FERC and the US Coast Guard, instead of blowing the whistle on the Department of State, have been complicit in the fraud.

Save Passamaquoddy Bay suggests that the State Department withdraw its opinion, and demands that FERC dismiss Downeast LNG's applications.
