Save Passamaquoddy Bay files notice to the US Department of Transportation (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) that FERC has failed since June 2009 to inform the DOT of LNG terminal tanktop fire thermal radiation hazards to the public. The computer modeling used for thermal radiation from LNG tanktop fires was demonstrated to be critically deficient. On January 15, 1993, FERC signed a Memorandum of Understanding (MOU) with the DOT to inform each other when a public safety hazard is identified regarding LNG and natural gas facilities. As of the SPB filing to the DOT, FERC has failed to notify the DOT of the public safety hazard identified in the 2009 filings to FERC -- FERC Downeast LNG Docket No. CP07-52, Comment Filings 20090707-5023(22040234) and 20091124-5066(23041052).

The FOIA request was for documents regarding the BIA's approval of a ground lease between Pleasant Point Passamaquoddy Tribal Government and Quoddy Bay LNG. The BIA failed to perform its statutory Indian Trust obligations prior to approving the lease.

BP Consulting ("Bug Picker" is an allusion to Ian Emergy's lobster fishing vocation, and is awkwardly similar to the name of energy giant BP) is formed by Maine State Representative Ian Emery of Cutler, Passamaquoddy State Representative Fred Moore III of Pleasant Point Passamaquoddy Reservation, and the Passamaquoddy Tribal Government at Indian Township. They propose to construct an LNG import terminal adjacent to Devil's Head conservation area near the village of Red Beach, Calais, Maine.
Both the name and ownership are to be short-lived. Just four months later (2005 Oct 20), the name is changed to Saint Croix Development, with owners consisting solely of Emery and Moore. They announce that Calais LNG will be the name of the LNG terminal, with Indian Township Tribal Government involved in ownership.
